What are the differences between the current and proposed Community Land Management Plan?
The current Community Land Management Plan (CLMP) for the Evelyn Halliday Reserve sits within a general CLMP plan that encompasses several open spaces across the Adelaide Hills region. You can view the current plan here.
The Evelyn Halliday Reserve currently sits within the generic CLMP for “Multi Purpose sites (refer page 4 – generic plan for all community land, and page 5 – multi-purpose sites).
The current CLMP for Evelyn Halliday Reserve attributes the following envisaged uses for the site:

To support further clarity around Council’s intentions for its Community Land, over time Council will be implementing stand-alone CLMPs for various sites, particularly sites that have multiple purposes such as this site.
The new map for the Evelyn Halliday Reserve CLMP now proposes the following uses/changes incorporating the inclusion of wildlife rehabilitation as shaded in purple:
The proposed CLMP is a new plan that has specifically been created for Evelyn Halliday Reserve. The purpose for which the land is held have now been explicitly outlined in the new Plan which is for an open space area, informal recreation facilities, conservation, community use and wildlife rehabilitation by a not-for profit organisation. The objectives for the management of the land are now explicit in the new draft Plan which is to manage, control and conserve the land in accordance with the Trust, to provide recreational facilities and space on the Land that are fit-for-purpose, safe, well maintained and accessible for people of all ages, backgrounds and abilities, and to provide or allow occupation rights to community and not-for-profit groups for information recreation, conservation, community uses and wildlife rehabilitation by way or lease, sub-lease, license, permit or management agreement.
What is the Trust ?
The Evelyn Halliday Reserve land was bequeathed to Council in the will of M Evely Halliday in 1991. The land is subject to a Declaration of Trust dated 7 October 1991 whereby it is to be used as a “Recreation Reserve for the general benefit of the community forever.” As owner of the land, Council is required to ensure that the uses on the land are consistent with the intent of the Trust.
What is a Lease ?
A Lease is an agreement between Landowner (Lessee) and Tenant (Lessor) whereby the Tenant is allowed exclusive occupation of land or premises with conditions around maintenance responsibilities for the site. The Tenant is allowed occupation of the site 24 hours a day, 7 days a week and has exclusive rights to lock/unlock and use the site in accordance with the terms of the Lease.
What is a License?
A License is non-exclusive in nature and allows rights to land only at certain times of the day or night, or on certain days of the week. It allows others to use the land at different times or at the same time.
Why is a Lease and a License proposed to be entered into with the Save our Wildlife Foundation Incorporated (SOWFI)?
A Lease is proposed to be used for those parts of the site where SOWFI would have exclusive use such as the dwelling, the Shed and the land on which the aviaries will sit. These parts of the premises are proposed to be used exclusively by SOWFI for the proposed Wildlife Finishing School purposes and therefore a Lease is proposed. The rest of the land will be licensed to SOWFI so they can have access to undertake their activities to tend to the animals and store items etc., but the intention is that the wider community will still have access to the land in and around the house, aviaries and shed for recreational purposes.
